Its probably a titular empire in my game because all the kingdoms that start as a de-jure part of the Empire of Italia (only Italy, not Sicily even though that is required to create it) have been part of the Holy Roman Empire for over 100 years so they are now a de-jure part of HRE through de-jure drift.
